1. Definitions
- “We” / “MyExplorio” — GC Hospitality Labs LTD, the operator of the website and booking service.
- “You” / “Guest” — any person who uses the website or makes a booking.
- “Activity Provider” — the independent third party that owns, organises and delivers an activity or experience.
- “Activity” — any leisure experience, tour, class or service offered for booking through MyExplorio.
- “Booking Fee” — the portion of the activity price that is charged online at the time of booking to secure the reservation.
- “Balance” — the remaining amount of the activity price, payable directly to the Activity Provider on the day of the activity.
- “Platform” — the website and the underlying booking technology used to create and manage reservations.
2. Our role — booking intermediary
We facilitate your booking, take payment of the Booking Fee and pass your reservation to the Activity Provider. Each Activity Provider is responsible for the activity itself, including its content, scheduling, quality, safety, insurance, equipment and compliance with applicable laws.
MyExplorio offers standalone leisure activities only. We do not combine an activity with transport, accommodation or vehicle rental, and we do not sell or arrange travel packages. Accordingly, a booking made through MyExplorio is not a “package” or a “linked travel arrangement” within the meaning of the Package Travel Directive (EU) 2015/2302 (transposed in Cyprus by Law 51(I)/2018), and the insolvency-protection and organiser-liability obligations of that regime do not apply to it.
3. Eligibility
You must be at least 18 years old and able to enter into a legally binding contract to make a booking. You agree to provide accurate, current and complete information. Where a booking includes other participants (including minors), you confirm that you are authorised to make the booking on their behalf and that you are responsible for them.
4. Booking process
- You select an activity, date, time slot and the number of participants.
- You provide your contact details (name, email and mobile phone number).
- We verify your email address and phone number using one-time codes (OTPs).
- You pay the Booking Fee online.
- On successful payment, your reservation is confirmed and you receive a confirmation and an activity pass (e.g. a QR code).
A booking is binding only once you have completed payment of the Booking Fee and received a confirmation. Availability is shown in real time and may change until your booking is confirmed.
5. Pricing & payment
5.1 Prices
All prices are shown in Euro (€) and include applicable taxes unless stated otherwise. The total activity price, the Booking Fee payable now and the Balance payable on the day are clearly shown before you confirm.
5.2 Pay now / pay on the day
To secure your reservation, the Booking Fee is charged online at the time of booking. The Balance is payable directly to the Activity Provider on the day of the activity, by the means the provider accepts. The split between the Booking Fee and the Balance is displayed at checkout and may vary per activity.
5.3 Payment processing
Online payments are processed securely by Stripe. We accept the payment methods shown at checkout (which may include cards, Apple Pay, Google Pay and other supported methods). Your booking is confirmed only after the Booking Fee payment has been successfully processed. We do not store your full card details.
6. Confirmation
A booking is confirmed only when you receive a written confirmation (by email and/or an on-screen activity pass) from MyExplorio. If you do not receive a confirmation, please contact us before assuming your booking is in place. Please present your activity pass and a valid photo ID to the Activity Provider on the day.
7. Cancellations, changes & refunds
Cancellation and change conditions are set by each Activity Provider and are shown at the time of booking. They form part of your contract with the provider.
- Cancellation by you — subject to the provider’s cancellation policy. Some activities are non-refundable; others allow free cancellation up to a stated deadline.
- Refunds — where a refund is due under the applicable policy, it covers the Booking Fee paid online. The Balance is not collected unless you attend, so it is not refundable. Refund requests are handled through our support team at [email protected]; refunds are not processed instantly online.
- Changes — requests to change a date, time or participant count are subject to the provider’s availability and policy.
- No-show — if you do not attend without a valid cancellation, the Booking Fee is generally not refunded.
- Cancellation by the provider — an Activity Provider may cancel an activity (for example due to weather, safety or minimum-numbers requirements). In that case you will be offered a re-booking where possible, or a refund of the Booking Fee.
Statutory right of withdrawal (distance contracts)
Activities are leisure services booked for a specific date or period of performance. Under Article 16(l) of the EU Consumer Rights Directive 2011/83/EU (transposed in Cyprus by Law 133(I)/2013), such contracts are exempt from the 14-day right of withdrawal. By completing a booking for a dated activity you acknowledge that no right of withdrawal applies, and cancellation is governed solely by the Activity Provider’s policy shown at the time of booking. Where an activity is sold without a fixed date (for example an open-dated voucher), the 14-day right of withdrawal does apply, and you may withdraw by an unequivocal statement to [email protected] within 14 days of the booking, provided the activity has not yet been fully performed.
8. Participation & conduct
Activities may involve physical effort, water, animals, transport or other inherent risks. You are responsible for ensuring that you and your party are fit and suitable to take part, and for complying with any age, health, safety, weight or experience requirements set by the Activity Provider. You must follow the provider’s instructions and safety rules at all times. The provider may refuse participation, without refund, where a requirement is not met or where conduct endangers safety.
9. Liability
As an intermediary, MyExplorio is responsible for operating the booking service with reasonable skill and care. We are not responsible for the performance, quality, safety or outcome of any activity, which is the sole responsibility of the Activity Provider.
To the fullest extent permitted by law:
- Our total liability arising out of or in connection with a booking is limited to the amount of the Booking Fee you paid to us for that booking.
- We are not liable for any act, omission, negligence or default of an Activity Provider, nor for personal injury, loss or damage arising during or in connection with an activity.
- We are not liable for indirect or consequential losses, or for events beyond our reasonable control (force majeure), including weather, strikes, transport disruption or provider closures.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
10. Intellectual property
The MyExplorio name, logo, website design, text and other content are owned by GC Hospitality Labs LTD or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, or commercially exploit them without our prior written permission. Activity descriptions and images may belong to the respective Activity Providers.
11. Acceptable use
You agree not to:
- Use the website for any unlawful or fraudulent purpose
- Make speculative, false or fraudulent bookings
- Interfere with, disrupt or attempt to gain unauthorised access to the website or its systems
- Use automated means to scrape, copy or harvest content or data
We may suspend or refuse service where these Terms are breached.
12. Complaints & dispute resolution
If something goes wrong, please contact us first at [email protected] and we will do our best to help. As we are an intermediary, complaints about the activity itself may need to be raised with the Activity Provider, and we will assist where we can.
If you are a consumer, you may also contact the Cyprus Consumer Protection Service: +357 22 818 700, www.consumer.gov.cy.
13. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Cyprus. As a consumer, you nevertheless continue to benefit from the mandatory consumer-protection provisions of the law of your country of residence under Regulation (EC) 593/2008 (Rome I, Article 6), and you may bring or be sued in proceedings before the courts of your country of residence under Regulation (EU) 1215/2012 (Brussels Ia). Subject to those mandatory rights, disputes are subject to the jurisdiction of the competent courts of Cyprus.
14. Changes to these Terms
We may update these Terms from time to time. The version in force at the time of your booking applies to that booking. The “Last updated” date above reflects the current version. Continued use of the website after changes constitutes acceptance of the updated Terms.
